5 Percent Preference
IMPORTANT NOTICE TO ALL VENDORS
Florida §287.084(2) requires the District to provide a 5% preference to vendors whose principal place of business is in Florida (“Resident Vendors”). As a result, new requirements are being imposed on vendors who are submitting bids. When listed as a required document, the Bidder’s Statement of Principal Place of Business Form included in the bid packet will need to be completed and submitted along with the vendor proposal. Resident Vendors will simply need to sign the upper portion of the form, affirming that their principal place of business is in the State of Florida. Non-Resident Vendors will be required to complete the form in its entirety. The form will require the written opinion from a licensed attorney in the state of the non-Resident Vendor’s principal place of business at the time of submitting the bid in order to be considered responsive. Bids will be rejected if the form is either incomplete, not signed by a licensed attorney, and/or not submitted if it is included as a required document. If completion of the form is not required as stated in the checklist, the form may be completed, however the bid will not be rejected for non-responsiveness if the form is incomplete or not submitted. Vendors and their licensed attorneys are encouraged to review the Statute carefully in order to avoid a non-responsive bid, proposal, or reply.
